  • The worst has happened...

    Well, the other day I was travelling S/B on Morningside, crossing @ Ellesmere (some of you Toronto guys may know), it's basicaly one big hill. So, I approached the hill roughly @ 80km/h in my Honda Civic and about halfway down the hill I had hit 110km/h (at the time I didnt realise my speed) and sure enough @ the bottom of the hill was police radar; they nailed me!

    I was doing 110km/h in a 60km/h zone. I was given an automatic summens to court and this looks like it is going to cost me quite abit. I'm probably looking for anwyhere between 3 - 4 points & a $300 - $400 ticket.

    The price of the ticket is really not the problem, its the points. My insurance is going to skyrocket on the T/A, which means I'm more than likely going to have to sell it.

    This has quite possibly been the worst day of my life. I realize you take a big risk when you speed but when it comes down to it, it wasnt a risk I would conciously be willing to make; I've lost my T/A!

    I'm 21 years old and this new year has been terrible to say the least. So, let this be a lesson to the guys and girls out their who are in and around my age... Speeding isnt worth it!!!!

    Now, having said all of this, would anyone be able to offer/suggest any legal advice?

      Short on not speeding, hire a traffic attorney. That's the only way to go.

        Could also fake a mechanical failure of your speedometer. That would get your ticket reduced to a no-points "fix it" ticket.

        I got out of the only speeding ticket I've ever gotten this exact way.
        here is how:

        1) disassemble the cluster and pull the needle off the speedometer. They are press fit on their little shaft.

        2) stick the needle back on so it reads very incorrectly.

        3) reassemble the cluster

        4) take it to a mechanic and have them document that it does in fact not work properly. Have them install a new used cluster you provide and get a receipt.

        5) give the receipt to the judge / DA/ whoever is reviewing your case and ask nicely for them to reduce the ticket to a non-moving violation of some sort.

          Seriously? Dang, I could gotten out of my biggest speeding ticket with that trick. Oh well...

          I guess it wouldn't hurt to try.

            Well, my ticket was for 80 in a 65. I doubt my trick would of worked if I was going much faster. At some point, you have to realize you are speeding regardless of whether or not your speedometer works

              The way you worded your post it sounds like it was photo radar and not an actual officer pulling you over. If this is true, then there are no points tacked onto your license. Correct me if Im wrong.

                do what Joe said. in Texas, 1989, before I moved back to VA...i hired an attorney, he beat my ticket.... 128mph in a 65mph zone........

                my Yamaha fj1200 out in the country too.......

                i got off with 35 dollars attorney fee........

                he kept showing up and appealing the case,.......till the office didnt show..then it got thrown outta court......

                happy camper was i.....that would have cost me tons...$$$$$$$$$$

                  Yeah, get a traffic attorney. They can usually either get the fine significantly reduced or dismissed. I had a 144 in a 70 dropped once in my TA. I was slowing down too - hehe. Municipal Court Judges usually have pretty good relationships with traffic attorneys.

                  We have the points system here in Texas as well, but it is rarely adhered to. Pay your fine and go.

                      I don't know what the Canadian laws are, so I would just use Joe's advise and hire a traffic attorney.
