  • Cop made an error on my ticket....

    I was pulled over 1:40 am on sunday may 29. He wrote on there 12:40 am may 28. Think that'll make a difference?

    For those who don't remember, the cop profiled me, followed me for a bit, pulled me over, asked for drugs, pulled out the dogs, etc... Then wrote me a ticket for a "Loud muffler"

    Any law people think I can get out of it with the date error? It's a longshot but it's worth a shot.

    I don't know if you can get out of it or not because of the date error, but keep in mind that since it was dated one day earlier, you will have one less day to respond to the ticket, I would contact someone in the magistrate office and let them know of the error. Hopefully they'll just drop it, but you never know.

      i think it goes by when the ticket enters the system not the date on the ticket. i could be wrong tho

        Your probobly right, the only time I got one was for speeding in my mom's outback lol . I thoguht it said like 10 days from the date, it could also change depending on where you are....it really seems like his ticket is bogus to begin with.

          Yes. I am not one of those guys that does stupid things and gets caught and then says it isn't true. I am a good driver. I have had one ticket that I deserved. I was racing a white cobra and got caught doing 10 over. He wrote me for 5 over.

          The rest are BS tickets. Smoking car, loud muffler, one cop said that I ran a red light. It was making a right hand turn, and the light had just turned yellow before I went under it. That was about a week after I got my license. He was a jerk. Then I got pulled over for no tail lights, and my proof was expired so I got a ticket for that. I do speed sometimes, and I do things that are worthy of tickets, but I've never been caught for them. I get busted for BS the majority of the time.

              I live in Florida and one thing is for sure. If the cop has the wrong date and times it is void. At least from personal experiences of mine and friends. I am not sure about your area. I would probably fight it.

                The problem is what do you have to prove it was the wrong time? I know you knew what time it was but you can't do anything but say it was a different time, if that's the case you could do that for every ticket.

                    yea, that was my ticket that they wrote the wrong date on. When i went to court the judge asked me how i plea, guilty or not guilty. I started to explain myself and he interupted right away with, "GUILTY OR NOT GUILTY?" I went with guilty. It would have been a burden if i would have went with not guilty.

                      In Canada that ticket would be void. I would just do quick trip to the local high school law teacher or to the nearest university law teacher and just ask if its void. By my understanding if the ticket is writen up wrong than its void. You didnt get caught with a loud muffler 25 hours before the cop wrote it up. who is to say the muffler want quiet at that time. If it were me I would fight it. I have fought many many tickets and won. Small mistakes make all the difference.

                      I have goten away with a ticket that was only 1 hour off from the actual time (day light savings saved my A**). 125 in a 60 zone. Automatic loss of licence for 6 months if convicted of driving 50 over or double the posted speed limit.

                        Take my advice....find a friend (or relative) in the legal system. I once got a ticket thrown out because the officer wrote down the wrong license plate (one digit) and wrong vehicle description.

                          find out what the max db level is for your local goverment (it has to be in the books for them to write a ticket), and barrow/buy a db meter and see.
                          if your well under you have 2 options.

                          1. take the db meter with you to court, to show a officer of the court the db levels in a on site test with him/her as a wittness for the court.

                          2. find a place willing to wittness and notorize a letter to the court stating that the db levels are ____db @____feet from 0 RPM to (your max. RPM) and fall within acceptable limits set forth by law.

                          if you exceed or come very close, double check it a little later, as the time of day, Air temp, and humidity will have a affect on the results.

                          most noise laws will state so many db's at a specific number of feet.
                          i.e. 80db@70feet

                          p.s. make sure you check the full range of the RPM's for the test, as it does not matter at which point that it exceeds, just the it does.

                          the above, along with the wrong date should be more than enough.

                            Bummer. Thats what they wanted. It would have been a burden, but the system will keep it up if we keep pleading guilty!.......but I understand your point.

                              Exactly. If the wrong info is on the ticket, then all you have to do is prove that you did not do what is stated on the ticket. If its the wrong date, it should be pretty easy to get someone to testify to the fact that you were somewhere else at the alleged time.
