Horsepower has nothing to do with emissions. Now if you do something illegal to achieve that horsepower...that's a different story. Like removing your cats, or tampering any emission controls on your car.
Yes, they do determine if your car is legal by emission laws. If you didn't have laws, you couldn't differentiate between legal and illegal.
You are a 97'. I'm sure it's an OBD-II car. As long as your SES light isn't on and you can pass a visual inspection. You'll be fine.
