Depends on the state. Indiana all you need is to have your tail lights seen from 500ft away

A search on this site finds following result. I think the one with the most replies had a similar discussion.

Blackouts are indeed illegal in most states. That's why the box usually says "for off-road use only". Not only that, but it's a potential liability as well. If you were to get rear-ended, as a general rule of thumb it would be the other guy's fault (following too close, not paying attention, etc) but if you've got blackouts, all they would have to say is they couldn't see your tailights because you've got blackouts (whether it was true or not) and you've got yourself one heck of a problem (tickets, lawsuit, etc...)

They're not worth the trouble, IMHO.

like everyone has said, in most states they are illegal. with my old camaro to get around that problem, and yes i did get pulled over for it. But, i went to a hobby shop, bought some spray tint, put a light coat of it over the tail lights, not enough to take really take away from it as much as the blackouts do. But when i got pulled over, they looked at that and questioned it, and i bs'd the officer that they were oem and came that way, because i pointed out the dot number that is stamped into the lights. worked fine for me, im not saying do this, but i never got a ticket for it and it looked good.
