I'm also curious as to why the other guy's insurance isn't paying for the car? They should be paying your medical bills as well. If he doesn't have insurance, then it's lawsuit time.

            • I know there are still many questions that haven't been answered, let me put some things in perspective. My plan is to not abandon my girl. I bought this car new, and based on what I see there is no reason to total the car. An insurance company would likely write it off and not fix it due to the fact that it is 10 years old with 150K miles. The fact that it was mint and everything
worked is moot. They go by cold, hard cash value and that's it. The only way I can assure the reality of bringing her back to life is to stay in control of just such a thing. Even if I have to get the ball rolling myself, I will not entrust this to a casual observer like a claims adjuster or any other non partial participant. Perhaps later on I can get some form of reimbursal, that will be put in the hands of an attorney when the time comes. One thing for sure, doing much of the work myself will be a labor of love and fitting for a girl that protected me from harm.

Florida is a no fault state, the insurance regulations are such that no matter what, my own insurance company is responsable for paying out my medical bills. They cannot recover that from the other driver's insuarance company. At this point, I still don't have all the information from the authorities and haven't had the time or energy to persue much except my health. I'm
starting to get to the point that I have to get things in order, but there is only so much I can do at any given time. Also realize, if the guy doesn't have appropriate insurance and doesn't have the dough, judgements don't mean squat. That's were the term blood from a rock comes from. In time I'm sure things will work out. Right now it's one step at a time. I want to thank everyone so much for your prayers and support, It's really great to have friends.

                • No fault...Just like here in Michigan...What a joke!!! I won't even get started. This will most likely end up in front of a judge. Just make sure your i's are crossed and your t's are dotted and you should make out alright.

                  • Joe, glad you're ok.

With $10k worth of damage, don't you think your insurance is just going to cut you a check for what it was worth instead of fixing it up?

If the frame is bent (I don't know if it is), the car would never be/feel the same even if you fix her.

A couple years ago a buddy of mine got T-boned (hard) in his C5. The insurance paid for it, but after he got it back it never felt the same to him. He would always have problems with it.

Joe only had liability insurance, so the company won't pay to fix or total the car. They would pay for injuries only.

Geez, I'm gone for a few months and this happens. I'm sorry to hear about everything that happened Joe, but I'm extremely glad you're safe and recovering. You've got my prayers to say the least. Let me know if there's anything I can do.

                            • Went to the Doc again yesterday, it was time to change the bandages. All is still looking good, but to me the progress is slow.

Also, my girl is coming home either today or tomorrow. It will be months of work, she's going into the garage so that I may start her rebirth. I don't mind building stuff, it's the tearing things apart that gives me the creeps. I'm doing major surgery on her, everything is coming off in order to do things right. I keep telling myself that it will be a labor of love. There's gonna be a whole lot of lovin'.

I seriously considered armored body panels and bullet proof glass.

                              • "No fault state" means that YOUR insurance pays YOUR medical bills... Its still up to the "at fault" partys insurance to cover replacing/fixing the property dammage. The truck drivers insurance should cover the dammage to the car. New Jersey is a "no fault" state as well.
