Because of the rubberband idiosy and similar "Over reaction rules" in the government schools my kids had to endure. We taught them to cut a cake with string instead of a plastic knife....... now it seems that might also be considered a weapon.

What amazes me is that all those people just stood there and watched! Someone should have stepped it to stop the fight. Even though I'm much smaller than that guy, I would have still tried to convice him to stop - even if I got my butt kicked too. This just shows that if something were to happen to you or your family, most people won't risk their own skin to help - that's total BS.

Even if I had a concealed weapons permit and was packing, I would not have helped.
a) you would had ended up beaten badly or killed if you tried to intervene unarmed
b) had you been armed, and pulled your weapon in that small room it is likely the the black guy would had attacked you, taken the gun from you, shot you and many others in the store.
c) had you been armed and did manage to get a shot off into the guy you would likely been put in jail and/or sued to a point you would never recover from it financailly. You can only meet deady force with deadly force, and there is no way you could prove the 300 LB monster had intentions to do anything but give the guy a few bruises. It would be a grey area of law, you could spend years and tons of $$ trying to defend yourself legally.

I dunno....I sat on a jury in a capital murder case a few years ago, and it was very simular (sp?) to this. The difference was that the victim died a few hours later from an epidermal hematoma. (Basically bleeding below the scalp, on top of the skull that puts pressure on the brain) We found him guilty of capital murder, because in Texas, intent doesn't have to be proven. It's a cause and effect kind of law: The defendant attacked and savagely beat the victim, as a result the victim died. End of story. Now in this case, the end result of that kind of beating could very easily have been the death of the victim. Police officers can use deadly force if they think that their life, or the life of another is endangered. Now a cop would probably have just tackled him or hit him with his asp or something, but if a civilian could make a case that he felt the man's life was in danger and that, if any lower level of force other than deadly force was used, then his life would be in danger, then I can see him having a good chance of not being prosecuted. This is all my theory, definitely not fact...just me thinking out loud...so to speak.

...have DJ Taso explain the "bystander effect" to you. He did a report on it after I mentioned it on this board a couple years ago and he was skeptical about it.
It's a psychological phenomenon, that no matter how valiant and brave you think you are, you would probably have stood and watched it all occur too.

I've been in plenty of situations exactly like that - some worse. I've always done what I can to help, distract, prevent, anything - but never have I stood there just watching like a useless dimwit. And look . . . I'm still alive! The "bystander effect" is a selfish excuse - a "better him than me" attitude. That is a CHOICE, not some unexplained mental reaction.

The bystander effect isn't a selfish excuse at all. In fact, those who understand it and what it means are MUCH less likely to allow themselves to fall victim to it.
It has nothing to do with those people being selfish. It has everything to do with each and every one of those people thinking, "man... they really need help. I'm sure that most people are good people like me who will want to help them. So... I don't need to help them because someone else will."
That's the bystander effect. It has nothing to do with selfishness, the people who fall victim to the effect are very good people, just like you and me.
Everybody always gets their panties in a bunch when I talk about this, because they don't like the TRUTH about human nature. You can't fight it. There's stuff inside ourselves that we don't like, and it's always hard to hear about it, but it's the truth. This effect is REAL, and it's human nature. it has noting to do with selfishness or cowardice in any way shape or form.

No probably not. But when these situations occur around me, I CHOOSE to help and overcome this "unexplained condition." I CHOOSE to risk myself to help another human-being. I refuse to make excuses to explain why I would stand there and watch something like this happen. It's a choice. You make yours, and I'll make mine. But if something were to happen to you, don't worry, I would help you. At least one person would.

Now that I know about the effect, I know there is very little likelihood that anyone else will call the police if I don't. Everybody thinks, "I'm sure someone has called the police. I don't need to bother them."
The fact is that the chances the police know about it are slim to ... and just about every time I call to report an incident, I am the first one to do so.

That's what I'm sayin'. Even if you're smaller than that guy, a couple good shots in the kidneys will make him think about stopping the beating...at least on that guy. Even the employees just sit there. I could not believe that.

So you would had put youself between a 300 LB pissed off, possibly drugged up monster and a stranger?
Your a braver man than I am then. You are aware that you would had likely gone to the hospital as well in that case. You would not had been able to stop him, and would had likey just made him more angry and aggressive. You would had accomplished nothing but escalating the situation.
I would not had sacraficed myself to stop it, but I would had done everything I could to help the guy afterwards, including being a witness for the police.
