I saw this story on 60 Mins a couple of years ago. Some of the people have bought homes on the waterfront worked there lifes to pay off the house and are looking to retire in something they worked hard all there lifes for. Then all of a sudden some elected officials in a city who don't live there say to themselfs you know those 10 houses pay there taxes on time but...if we tear them down and give the land to a hotel company there taxes will be higher and the visitors will help the local ecconomy...
Thats scarry, where dose that sort of power end and who regulates it, if the courts say the lowest form of goverments do, thats real cause for concern.
Lucky I live in Canada but we tend to mimic US policies up here so who knows what will happen in a couple of years...

Yea Jay. Some builder decides he wants to build a shopping center where your new house is and you have to sell it to him.

All the ruling says I think is that raising the tax base or creating employment can make the property qualify as eminent domain. It doesn't address value. Can you be forced to sell it to them for a dollar? I don't know.

I think that it has always been legal for the government to take any land that they want, its called “Eminent Domain”, as most people are familiar with. The difference is that the government has now gotten absolute power to do it without any “ifs ands or buts“. You should start to see the US government gaining more and more power as time goes on-that is what the Patriot Act is all about. Its funny how we are promoting all of this Liberty and Freedom in the Middle East and other places around the world, yet we are losing more and more freedoms and liberty every day since September the 11th. I saw on Fox News yesterday that the Clintons have been invited to the Bush’s Kennebunkport home to hang out with one another for some reason. Also, if you have seen the news, George Bush senior and Bill Clinton, joined together for tsunami relief a while back. They have actually become good buddies Now they are getting cozy with Hillary, now that the news media has convinced her to run for President. It appears that the Bush's want to sort of silently support her and Bill to win the White House in 2008 If she somehow manages to win, get ready for some more freedoms lost.

The problem has been with the definition of public use. Up until today it has meant things like roadways, power lines or municipal buildings. Today's ruling has changed that dramatically. This country just took a big step towards socialism.

What can you do about it. There is no recourse for a supreme court ruling. I guess it could be appealed but why would they overturn their own ruling. And I think that any law that congress could write to fix this travesty would over ruled by this ruling.

It is a stretch, but they sure are cozy with one another right now If you think about it though, we are most likely going to have a Democrat in the White House after the 2008 election, because of the huge deficit that our "War on Terror" has created. You need Democrats in office to raise the taxes, to pay down the deficit, just like Bill Clinton did for 8 years. Everyone knows that a Democrat in office means higher taxes. If she somehow gets elected, she will get the deficit paid down or paid off, but she will ruin the economy again, just like her husband did.
