  • Wow! This is a rather odd situation..... you guys won't believe this!

I get a call at work today. My car is in the impound lot and they want me to come get it out. I immediatly freak out and go running out into the parking lot. There she sits. I call back the impound lot, the guy tells me my car has been there for a week. A trace was done and according to the state, I own the car and they want to collect. At this point I don't know what the heck is going on. I start asking questions and come to find out, the blue 94 Z28 that I sold a few months back was the car in the impound with 4 flat tires, no battery, but everything else appears intact. I made a few phone calls and get ahold of the guy's wife. She tells me that she is in middle of a divorce, hubby is an alcoholic and has left the state. I start inquiring about the Camaro and evidently he never titled it, that's how the a trace of the VIN came back as me being the current owner. There were numerous items that she said were missing, her husband has skipped town with money, personal belongings and the list goes on and on. The Camaro was evidently one item that was a source of one of the fights. The bottom line is she said she would give me the title and I can have the car back with no strings attached, supposedly out of pure spite for her soon to be ex-husband. All I have to do is come up with the impound fee and if he does return, not divulge any info as to what she "sold" the car for. Is this too good to be true? This definately ranks at the top of the wierd list for the day. The impound fee is $370, but climbs daily. It is the worst possible time financially, but would I be crazy to not go get the car?

I would say go for it. First of all the car is still in your name and if she gives you the title, you got it all.

Might be a break on your horizon. Fix it up and you can probably sell it to make a profit and put the money towards house repairs.

The only thing that would kind of worry me is the husband, but then if you have the paperwork he can't do much about it besides being a jerk.

At least go have a look and see what condition it's in - even in rough condition, you can probably turn it around and make a few bucks! As long as you don't have to sink too much into it to make it roadworthy, then it sounds like a good deal. Also, get that title in your hands BEFORE you put any money into it!

I agree with everyone else. If there aren't too many problems with it, you can easily make a profit off of it. Do it.

            VERY important.

Also, if this guy has a crimial tendency to be violent AND knows where you live, prepare to be confronted and hope he doesnt have a gun.

I'd probably pass on it just so I didnt get involved in the anger of his divorce. The last thing you need is a psychopath on your back.

That is the first thing that I thought of..... However, the guy is kind of a wimp and has fled the state. His wife didn't tell me all the details but it sure seemed like he was running for a reason and she made it sound like it was unlikely he would be returning. I'm going to talk to her on the phone again after 8:00... I told her I would call her back tonight. If possible, I'm going to swing by to pick up the title and try to bail out the car in the morning. My guess is that something is wrong with the car but I won't know until I hook up a battery and see if it runs. I still have a set of keys that didn't go with the car. I couldn't find them at the time of sale but they turned up while cleaning the house after all the hurricane crap.

                  My two cents worth-
Basically she is offering to sell you back the car for the impound fee. If she can find the title that you gave them with the car, evidently there is not a lien on the car. If there was, you might have a possible repossession problem looming in the future. If you gave them a Bill of Sale, you need to get that back along with the title, just to be on the safe side, and once you get it, either hide it really well, or conveniently lose it. Even if she can’t find the Bill of Sale, then it would be a good idea to make up a new one, stating her as the seller and you as the buyer. Just have it state that she is selling it to you for the exact amount of the impound fee, whatever it happens to be at the time. Don’t put “impound fee” on the Bill of Sale though, just put the dollar amount. You can easily type up a Bill of Sale on the computer, and have everything except the signatures printed out on it.

BTW, you really need to get that old Bill of Sale back from her if at all possible, unless it had both of their names on it, because it is a legal document. If she is not on it, and didn't sign it, then technically you could run into problems, depending on your state laws, if he has it and wanted to keep the car. Also, be careful dealing with people like that -

I had a similar situation happen to me. I was called about 2am by the Cobb County police department and asked if I owned a VFR700F Honda Interceptor. I said I used to. I sold it a few months back. What had happened was I sold it and signed the title to the guy I sold it to. He never turned it in. His girlfriend told him to sell it about a month later so he did. He gave the filled in title to the guy and now he can't get a title in his name because it had never been turned in by the previous owner. So he sat on it a few months. Well he was out drinking, not a good thing to do in car but much worse on a bike, and he got picked up for a DUI. They said I could come get the bike. I said no, they could keep it. I didn't want to fool around with getting the title straightened out.

If you go get it, get a car cover for it so it least if the guy comes by, he won't see it sitting there. Get one for the T/A too so it looks normal for you to have covers.

After calling, I stopped by after work and picked up an envelope of papers.... the original bill of sale , and the Title. Question is, I signed off the title when I sold it, but he never signed it. Can I just apply for a duplicate title or is this one still good? Never seen a situation like this before. At least I have everything that was connected with the sale except the owner's manual. Too bad she can't find that, it was the original one from the first owner. I do still have all the receipts, I never sent them with the car when I sold it. Still..... this all seems too good to be true. Something has to be wrong with the car. I guess I'll know more in the morning.

Hey man, if you need a place to hide her, I've always got the room. Granted its not exactly down the street, but I'll hold her for ya if you need lol. I would say go for it, fix it and sell it if you need the money. Otherwise, I'm sure you can handle the guy. You've always got all of us for backup too
